To submit your Photo(s), please read the following photo submission rules and click on the checkbox above. 1. By submitting your Photo(s) (each a "Photo") to Bell Canada, by its Sympatico Portal Division ("Sympatico"), you grant to Sympatico a royalty-free, non-exclusive license, in perpetuity, throughout the world, and in any media now known or hereafter devised, to use, modify, reproduce, exhibit, broadcast, communicate, transmit and distribute by electronic means, and to alter and otherwise combine the Photo(s) with other content in any manner and in any media whatsoever, including, on websites operated by Sympatico. 2. To submit your Photo(s) to Sympatico you must be: (i) a resident of Canada; and (ii) have reached the age of majority in the province of residence at the date of submitting your Photo(s) to Sympatico. 3. You represent to Sympatico that each Photo is an original work by you, that: (i) you own or control 100% of the rights in the Photo(s); (ii) the rights granted to Sympatico hereunder are free and clear of any claim, right and obligation; (iii) that you have the right to grant to Sympatico the rights granted hereunder, and you do not require a consent of any third party; and (iv) that there is no contract with any third party that could in any way interfere with Sympatico?s rights hereunder or require payment or any compensation to anyone by Sympatico, including, without limitation, to you. 4. You agree to indemnify and hold Sympatico harmless from and against all claims, demands, loss, damages and expenses (including reasonable attorney fees and disbursements) and liability arising from any third party claim brought against Sympatico alleging that: (i) the Photo(s) infringe any intellectual property right of any third party; (ii) contain material or information that is obscene, defamatory, libellous, slanderous or violates any individual?s right to publicity, privacy or contains any virus; or (iii) any third party claim inconsistent with your representations or in connection with Sympatico?s use of the Photo(s). 5. All Photos: a. must represent scenic places, landscapes, landmarks, etc. b. must not contain people; c. must be a color or black and white digital photo or color or black and white scan photo from a film-based camera; d. must be in .jpg or .gif or png, or .bmp format, size no larger than 2MB (2,000 KB); e. must not contain time and/or date stamps or have decorative borders; f. must not copy, reproduce or otherwise use, in whole or in part, without the express written consent of the owner thereof, any trade-mark, copyright-protected work or other intellectual property of any third party; and g. must not contain or depict any pornography, libel, slander, obscenity, profanity, threatening, degrading or demeaning language, symbols or behaviour or other material which may, in the opinion of Sympatico, in its sole and absolute discretion, offend prevailing community standards of decency or appropriateness. 6. All Photos are subject to selection, review and/or editing by Sympatico, in its sole and absolute discretion. All Photos chosen to be posted may be altered by Sympatico to ensure that no identifiable individual is featured within any Photo. Sympatico also reserves the right to require you to provide satisfactory proof of any third-party consent which appears to Sympatico, in its sole and absolute discretion, to be required in respect of any Photo. Sympatico does not guarantee that a Photo will be used. In addition, Sympatico reserves the right to remove any Photo from its website or from any other medium in which the Photo has been posted. 7.
